IVC filter product liability cases filed against C.R. Bard have been increasing. Most of these cases allege that one of C.R. Bard's Recovery-family IVC filters migrated, fractured, perforated the Inferior Vena Cava, tilted or failed in some other respect resulting in serious injury or death. In addition, the cases allege that the filters lack efficacy, i.e. do not prevent blood clots from reaching the heart or lungs and may even increase the risk that blood clots will reach the heart or lungs.
On August 18th, 2015, the Federal Judicial Panel on Multi-District Litigation (JPMDL) ordered that all cases filed in federal court against C.R. Bard alleging death or injury caused by one of the Recovery-family IVC filters be consolidated before Judge David G. Campbell in U.S. District Court for the District of Arizona. The Bard IVC Filter MDL (No. 2641) was consolidated in Arizona since C.R. Bard's subsidiary that designed, manufactured and marketed the IVC filters – Bard Peripheral Vascular, Inc – is located in Tempe, Arizona.
